ETHIOPIAN LAW - የኢትዮጵያ ህግ

 ተጠሪ *         ዳንኤል ፍቃዱ / የህግ አማካሪና ጠበቃ/ * አንድ ተቋም ለአንድ ሌላ ተቋም ወይም ግለሰብ ተጠሪ ነው ሲባል ምን ማለት ነው? ምን መብት ምን ግዴታስ በተጠሪው ላይ ይፈጥራል? በጠሪው ( ይጠራልህ በተባለው)ግለሰብ ወይም ተቋም ላይስ?  ከህገ መንግስቱ አንስቶ መመሪያ ድረስ ያሉ ህጎች ላይ ይህች ቀላል እምትመስል ቃል በየቦታው ተዱላ እንመለከታታለን ። በእንግሊዝኛው በተለዋዋጭ Accountable ወይም Responsible በሚል ተገልፃ እናገናታለን።  እውቁ የህግ መዝገበ ቃላት Blacks law Dictionaryንም ስንመለከት ቃላቱ በተለዋዋጭ / interchangeably/ አገልግሎት ላይ ሊውሉ እንደሚችሉ ሲያጠይቅ: Accountable = Responsible በሚል ይተረጉመዋል። ስለዚህ ሃላፊነት፣ ተጠያቂነት፣ መልስ ሰጪነት ፣ ወዘተ ተብሎ ሊተረጎም ይችል ይሆናል። ለምሳሌ ያህል ፩/  የኢፌድሪ ህገ መንግስት አንቀፅ 49 (3) ላይ " የአዲስ አበባ ከተማ አስተዳደር ተጠሪነቱ ለፌደራሉ መንግስት ይሆናል። " ይላል። ምን ማለት ይሆን ?ሰበር በሠ/መ/ቁጥር 34665 ቅፅ 10 ላይ  " የጠቅላይ ሚኒስትር ፅ/ቤት የሚኒስቴር መስሪያ ቤቶችን ስራ የመከታተልና በበላይነት የመቆጣጠር ስልጣን ያለው እንደመሆኑ መጠን የስራና ከተማ ልማት ሚኒስትር ቤቶችን የሚመለከት ጉዳይ ለአዲስ አበባ ስራና ከተማ ልማት ቢሮ እንዲያስተላልፍ በተሰጠው ትዕዛዝ ( ጠቅላይ ሚኒስትሩ በደብዳቤ ባስተላለፉት ) መሰረት ስራውና ሰራተኞችን ለቢሮው አስተላልፏል ። "  ይለናል ይህ ማለት እንግዲህ  የከተማ መስተዳድሩ በሚያወጣቸው ህጎች እና በሚወስናቸው ውሳኔዎች ሁሉ የፌደራሉን ይሁንታ ማግኘት አለበት ማለት ነው? ፌደራሉ የአዲስ አበባ ከተማ አስተዳደር

One of the matters the Draft Code regulates relates to the criminal jurisdiction of courts over crimes under the 2004 Criminal Code. This article examines Article 25 (3) of the Draft Code that empowers Courts of State of Oromia to exercise jurisdiction over some criminal cases in Addis Ababa. When seen in the light of the Constitutional division of power between the Federal Government and the States, this provision is constitutionally dubious and pragmatically flawed.
